Criteria for the delimitation between medicaments, food-stuffs and utility articles

It is not always easy to classify products into the categories foodstuffs, medicaments and utility articles. Delimitation criteria help classification.

Whereas in some countries in Europe certain products are classified as foodstuffs, they are considered as medicaments in other countries. In order to avoid such differences Swissmedic and the FSVO have developed criteria for the classification of products (see the report under “Further information”). They take account of both Swiss law and Swiss judicial practice as well as that of the EU and the judicial practice in the EU.
